01 Acceptance of Terms

By creating an account or using OpenCurtain (“the platform,” “the service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

We may update these terms from time to time. We will notify registered users of material changes by email. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.

02 Eligibility

OpenCurtain is intended for use by current or former health care professionals, including but not limited to registered nurses, licensed practical nurses, certified nursing assistants, advanced practice registered nurses, physician assistants, respiratory therapists, physical therapists, occupational therapists, surgical technologists, medical assistants, and other allied health professionals.

You must be at least 18 years of age to use the platform. By creating an account, you represent that you meet this requirement.

You must complete the credential verification process to submit reviews. Providing false or fraudulent credentials is a violation of these terms and may result in immediate account termination.

03 Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@opencurtain.com if you suspect unauthorized access.

You may not create multiple accounts, share your account with others, or use the platform on behalf of someone else.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or compromise the integrity of the platform.

04 Reviews & Content

Accuracy and honesty

Reviews submitted to OpenCurtain must reflect your genuine, first-hand experience working at the facility you are reviewing. You may not submit reviews for facilities where you have not personally worked.

Prohibited content

You agree not to submit content that:

• Is false, misleading, or fabricated
• Is defamatory, harassing, or targeted at an identifiable individual
• Discloses confidential patient information or violates HIPAA
• Is submitted to target a specific individual rather than reflecting genuine workplace conditions
• Contains hate speech, discrimination, or content that violates applicable law
• Is submitted on behalf of a competitor, employer, or any party with a financial interest in the review
• Includes personally identifiable information about patients, colleagues, or other individuals

Your ownership

You retain ownership of the content you submit. By submitting a review, you grant OpenCurtain a non-exclusive, royalty-free, worldwide license to display, distribute, and use that content in connection with operating the platform. This license ends if you request deletion of your account, though anonymized review data may be retained as described in our Privacy Policy.

Content moderation

We reserve the right to remove any content that violates these terms or that we determine, in our sole discretion, to be harmful to users, hospitals, or the integrity of the platform. We are not obligated to review all submitted content prior to publication.

05 Content Guidelines

What makes a good review

OpenCurtain reviews are most valuable when they are specific, honest, and based on direct personal experience. A good review focuses on workplace conditions, staffing, management culture, compensation, and overall experience — not on individuals.

What is allowed

• Honest descriptions of your experience working at the facility
• Feedback about management style, culture, or practices (without naming individuals)
• Factual data points — patient ratios, pay rates, break policies — as you experienced them
• Both positive and negative experiences, as long as they are genuine
• Descriptions of systemic issues, staffing practices, or workplace conditions

What is not allowed

• Naming or identifying individual staff members, managers, or colleagues
• False or fabricated claims presented as fact
• Patient information of any kind — this is a strict HIPAA concern
• Content that is harassing, discriminatory, or targeted at a specific person
• Reviews of facilities where you have not personally worked
• Content submitted on behalf of another person, employer, or organization

Reporting a review

If you believe a review violates these guidelines, you can report it using the Report button on any review card. Please only report reviews that genuinely violate these guidelines — not reviews you simply disagree with. Disagreement with a review is not grounds for removal.

Moderation

OpenCurtain reserves the right to remove any review that violates these guidelines. When a review is removed, the submitting user will be notified with a brief explanation. Repeat violations may result in account suspension.

06 Verification & Credential Submission

To submit a review, you must verify your credentials by uploading a photo of your health care facility badge and verifying your identity with either a real-time selfie or a photo of your driver's license or state ID.

By submitting verification materials, you represent that:

• The credentials you provide are genuine and belong to you
• You are currently or were previously employed at the facility you are reviewing
• You have not altered, forged, or misrepresented any credential or identity document

07 Anonymity & Identity Protection

Your identity is never visible to the public or where you work. Your reviews are anonymous to everyone except you. We do not disclose the authorship of any review to any party — including hospitals, employers, or law enforcement — except as required by law.

While we take significant technical measures to protect your anonymity, you should be aware that no system is completely immune to vulnerabilities. You are responsible for not including information in your review that could identify you (e.g. unique personal details, names of colleagues, or highly specific incidents that could be traced back to you).

08 Prohibited Uses

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to reverse-engineer, scrape, or extract data from the platform without authorization
• Interfere with or disrupt the platform's infrastructure, servers, or networks
• Attempt to circumvent the verification system or submit reviews without proper credentials
• Use automated tools, bots, or scripts to interact with the platform
• Impersonate another person or health care professional
• Attempt to de-anonymize reviews or identify other users
• Use the platform to collect information about other users without their consent

09 Intellectual Property

The OpenCurtain name, logo, design, and platform code are the intellectual property of OpenCurtain and may not be used, reproduced, or distributed without our written permission.

User-submitted review content remains the property of the user who submitted it, subject to the license granted in Section 4.

10 Disclaimers

OpenCurtain provides a platform for health care professionals to share their experiences. We do not verify the accuracy of individual reviews beyond confirming that they were submitted by credentialed health care professionals.

Reviews represent the personal opinions and experiences of individual contributors and should not be treated as definitive assessments of any facility. OpenCurtain makes no representations or warranties regarding the accuracy, completeness, or usefulness of any review.

11 Limitation of Liability

To the fullest extent permitted by law, OpenCurtain shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the platform shall not exceed the amount you paid to use it in the twelve months preceding the claim.

12 Indemnification

You agree to indemnify and hold harmless OpenCurtain and its team from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your submission of content that infringes on the rights of a third party.

13 Termination

You may request the deletion of your account at any time through your account settings or by contacting us at hello@opencurtain.com.

We reserve the right to suspend or permanently terminate your account at any time if you violate these terms, engage in fraudulent or abusive behavior, or if we determine that your continued use harms the platform or its users.

Upon termination, your account information will be deleted. Anonymous review content you have submitted may be retained as part of the platform's dataset, as it is not visible to the public or where you work and cannot be connected back to you.

14 Governing Law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the platform shall be resolved in the courts of Miami-Dade County, Florida.
